By creating an account or using TriFocus UX ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
TriFocus UX is a UX auditing platform that analyses websites against research-backed UX guidelines. The Service provides automated scoring, AI-powered recommendations, competitor benchmarking, and report generation.
3. User Accounts
- You must provide a valid email address to create an account
- You are responsible for maintaining the security of your account credentials
- You must not share your account or allow unauthorised access
- Guest accounts have limited functionality and do not persist across sessions
4. Credits & Payments
- The Service operates on a credit-based system. Each audit, export, or AI-powered analysis consumes credits.
- Free Trial accounts receive a one-time allocation of credits for evaluation purposes
- Paid plans provide a monthly credit allocation as described on the Pricing page
- Credits do not roll over between billing periods unless otherwise specified
- All payments are processed securely through PayPal
- Refund requests must be submitted within 14 days of purchase
5. Acceptable Use
You agree not to:
- Use the Service to audit websites you do not own or have permission to analyse
- Attempt to reverse-engineer, decompile, or extract the scoring algorithms
- Submit malicious URLs or attempt to exploit the Service
- Resell or redistribute audit results without a white-label licence (Enterprise tier)
- Exceed rate limits or abuse API access
6. Intellectual Property
The UX guidelines database, scoring methodology, and platform design are the intellectual property of TriFocus UX. Audit reports generated for your websites are yours to use, share, and distribute.
7. Accuracy & Limitations
TriFocus UX uses deterministic, evidence-based scoring combined with AI analysis. While we strive for accuracy:
- Audit results are advisory and should not be treated as legal compliance certification
- AI-generated recommendations may not be suitable for every context
- Scores may vary based on website availability, content changes, and regional settings
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will endeavour to provide notice of planned downtime.
10. Termination
We reserve the right to suspend or terminate accounts that violate these terms. You may close your account at any time by contacting us through our Contact page.
11. Limitation of Liability
TriFocus UX is provided "as is" without warranty. We are not liable for any damages arising from your use of the Service, including but not limited to business losses based on audit recommendations.
12. Changes to Terms
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
